UWANI MUSA ABBA AJI, J.C.A. (PJ) (Delivering the Leading Judgment): This is an appeal against the judgment of the Imo State High Court holden at Owerri delivered by Hon Justice Chioma Nwosu-Iheme (as he then was) on 30/11/2006, wherein the claims of the Appellants herein before as the Plaintiffs at the lower court was dismissed.
The claims of the Appellants, jointly and severally against the Respondents at the lower court in suit No: HOW/13/95 against the Respondents were as follows:
a) A declaration that none of the properties, subject matter of the letter administration of the Estate of Sylvester I, Egbuchulam (deceased) of Orodo in Mbaitoli Local Government Area of Imo State dated 7/6/88, including the Certificate of Additional Assets dated the 25/10/90, granted to the Plaintiffs by the High Court of Imo State, is or was ever jointly owned by the deceased Sylvester I. Egbuchulam and the 1st Defendant Luke Egbuchulam, namely
