The appellant was convicted by the High Court (Bolgatanga) on 17th May, 2010 for “Being in possession of Narcotic drugs contrary to section 2 (1) (2) of Possessing narcotic drug contrary to the Narcotic Drug (Control, Enforcement and Sanctions) Law, 1990 (PNDCL 236)”. The particulars of offence are that on or about the 12th day of June, 2007 at Bolgatanga in the Upper East Region and within the jurisdiction of this Honourable Court he was found in possession 10.0 grammes of Cannabis a Narcotic Drug without lawful authority. The facts of the case as given by the prosecution are that on the 11th of June, 2007 at Bolgatanga one Kipo Bedo reported a case of stealing involving an amount of  ¢39,514,000 old cedis from the Ndaa Guest House in Bolgatanga.  The caretaker of the guesthouse was arrested and he mentioned the accused person Elvis Dorsah as one who slept in the guest house but left without notifying the caretaker. The accused was spotted on the 12th of June, 2007…
