ISAIAH OLUFEMI AKEJU, J.C.A. (Delivering the Lead Ruling): The Respondent herein was the plaintiff in suit No. PHC/264/97 commenced at the High Court of Rivers State through the Writ of Summons filed on 24th February, 1997 for the following reliefs against the Appellants as the defendants;

1. A declaration that the purported dissolution of the six internal members of the Governing Council of the University of Port Harcourt is improper, illegal, null and void.

2. A declaration that the purported removal of the plaintiff from the Governing Council of the University of Port Harcourt is illegal null and void.

3. A declaration that the plaintiff is still a member of the Governing Council of the University of Port Harcourt until the expiration of his term of office on 1st August, 1997.

4. A perpetual injunction restraining the Defendants, their agents or privies form denying the plaintiff of all his rights and privileges as a member of the Governing Council of the University of Port Harcour…
