CHIDI NWAOMA UWA, J.C.A. (Delivering the Leading Judgment): The Lagos State High Court (hereafter referred to as the lower Court) in its Ruling delivered on 25th day of June, 2015 by B. A. Oke-Lawal, J rejected a document, the Appellant’s Standard Operating System Procedure in evidence and marked same as rejected.
The background facts are that the 1st Respondent as claimant at the lower Court sued the Appellant as the 1st defendant in its Amended statement of claim and sought the following reliefs:
1. “The sum of N45,445,950.00 (Forty-Five Million, Four Hundred and Forty-Five Thousand, Nine Hundred and Fifty Naira only) being the balance unpaid on LPO No. 13565 issued by the 1st defendant and executed by the claimant and interest on the said sum at the rate of N1,200,000 per month from the 26th of April, 2012 till judgment is given and thereafter at the rate N1,200,000 per month till judgment debt is totally liquidated.
