JUDGMENT

INTRODUCTION

On the 26th of March, 2018, Plaintiff issued a Writ of Summons and its accompanying  Statement of Claim at the Registry of this Court against Charlotte Ogbedie Ashitey  (trading as Chelly Ash Enterprise the Defendant herein for the following reliefs; 

a) An order for the recovery of GHS69,654.82 being the outstanding collective  indebtedness of the Defendant to the Plaintiff as at 29th August, 2017.

b) Interest on the said sum at the actual interest rate of 3.08 percent per month from  30th August, 2017 till date of final payment. 

c) Penal interest on the said sum at the agreed penal rate of eighteen (18) percent per  annum from 30th August, 2017 till date of final payment.

d) Further or in the alternative an order for the judicial sale of an uncompleted  residential property situate at Parcel No. 20 Block 16 Section 206 Ablekuma in  Accra belonging to the defendant and covered by Land Title Certificate number  GA 43948. 

e) Cost on a full indemnity basis.
