YARGATA BYENCHIT NIMPAR, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of the Lagos State High Court delivered on the 29th December, 2014 by HONOURABLE JUSTICE L. A. OKUNNU wherein the Appellant was found guilty of the offences of forgery and uttering forged letter contrary to Section 467 and 468 of the Criminal Code, Cap C17 Vol.2; Laws of Lagos State 2003 which are counts 3 and 4 of the charge sheet and was accordingly sentenced to a term of one year imprisonment. Aggrieved by the said decision, the Appellant filed a Notice of Appeal on the 2nd February, 2015 setting out 16 grounds of appeal.

The Appellant was arraigned before the Court on a 4 counts charge of mainly forgery and uttering of forged documents. He pleaded not guilty and thereafter trial commenced with the prosecution calling 5 witnesses and tendered several documents as Exhibits and the defendant also called 5 witnesses.
