JUDGMENT

ASUMAN-ADU, J.

The applicant issued out Writ of Summons against the defendant on 17^th November, 2000 for the following reliefs:

“1. The recovery of the sum of ¢12,800,000.00 being the cost of assorted beams and scantlings entrusted to the defendant (to convey from Atieku to Dome near Accra) who loaded them on van No. 5063 on 9^th September, 1998 but which it has failed to deliver despite several demands.

2. Interest on the sum of money from the 9^th day of September, 1998 at current bank rate till the day of payment.

3. Costs.”

The plaintiff accompanied the Writ of Summons with a Statement of Claim in which he avers that on 9^th September, 1998 the defendant hired its van No.5068 to him to load assorted beams and scantlings from Atieku to Dome in Accra. He states that he paid ¢219,450.00 (GH¢21.95) for hiring the van and receipt No. 133001 was issued to him.
