D. MUHAMMAD, J.C.A. (Delivering the Leading Judgment): The appellant in this appeal was the applicant at the court below. The respondent was the respondent thereat. Pursuant to his application dated 18th August, 2000, appellant had obtained leave from the Lagos State High Court to enforce his fundamental human rights as guaranteed by the 1999 Constitution of the Federal Republic of Nigeria. Appellant felt his rights as stipulated under sections 34(1)(a), 36(1) and 44(1) of the Constitution were breached and or threatened. Leave was granted the appellant to enforce these rights in an order dated 11th September, 2000. The substantive application for the enforcement of appellant’s rights against the respondent was heard and concluded by the trial Judge Hon. Justice A. B.
