ABUBAKAR MU’AZU LAMIDO, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of High Court of Jigawa State delivered by A.S. Muhammad J. on 24th February, 2020. The Appellant as 1st accused person was charged along with other person for the offences of criminal conspiracy and culpable homicide punishable with death contrary to Sections 97 (1) and 221 (b) of the Penal Code Law of Jigawa State.
The two Charges filed against the Appellant and another read as follows:
1. That you Badamasi Gawoni ‘M’, Garba Datti ‘M’ and three others now at large, on or about the 19th day of January, 2019 at about 23:00 hrs at Sabuwar Rijiya Fulani camp, Garki Local Government Area of Jigawa State within Jigawa Judicial Division did conspire among yourselves and caused the death of one Magaji Musa and thereby committed the offence of criminal conspiracy punishable under Section 97 (1) of the Penal Code, CAP P3, Laws of Jigawa State, 2012.
