MOHAMMED LAWAL GARBA, J.C.A. (Delivering the Leading Judgment): The Appellant was one of the Defendants jointly charged before the Federal High Court, Lagos in charge No. FHC/L/209C/15, long with the Appellants in Appeals No. CA/L/909C/16 - CA/L/909co/16 against the judgment delivered on the 18th March, 2016, which were determined by the Court on the 19th December, 2017. The Appellant was the 3rd Defendant in the charge.

This appeal could not be taken along with the other sister appeals against the judgment by the Federal High Court convicting all the Defendants for the offences they were charged with, because it was not ready or ripe for hearing at the time the said appeals were heard.

The Appellants Notice of Appeal was filed on the 22nd June, 2017 and from the thirteen (13) grounds contained thereon, three (3) issue are distilled for determination in the Appellants brief filed on the 24th August, 2017, deemed on 5th October, 2017. They are as follows: -
