HARUNA SIMON TSAMMANI, J.S.C. (Delivering the Lead Judgment): This appeal is against the judgment of the Court of Appeal sitting at Jos delivered on the 24th day of June, 2014 in Appeal No. CA/J/88/2013. 

By a Writ of Summons and Statement of Claim, both filed on the 26th day of May, 2009, the Appellant who was the Plaintiff, claimed the following reliefs:

1. A Declaration that the Plaintiff has a right of possession and occupation of a piece of farmland being, lying and situate at Maishamari Ward Gamboru Ngala road, opposite the new housing estate, Maiduguri and measures 600 by 450 ft, consisting of fifty (50) plots. 

2. An order declaring the sale of the plaintiff’s pieces of farmland by the 1st and 2nd Defendants to the 3rd Defendant without his knowledge, consent and/or authorisation as illegal, wrongful, unconstitutional, null and void.
