<p>JAMES SHEHU ABIRIYI, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment delivered on 1st April, 2014 in the High Court of Borno State holden at Maiduguri.</p><p>The Appellant as plaintiff claimed against the Respondent as defendant the following:</p><p>a. A declaration that the Plaintiff has a right of occupation, possession of land title to a piece of land measuring 72.6m by 55.6m being, lying and situate at Custom Area Maiduguri.</p><p>b. A declaration that the Defendants act of trespass unto the piece of land and claim of adverse title to same is illegal, wrongful, unconstitutional, null and void.</p><p>c. An order of perpetual injunction restraining the Defendant whether by himself, agents, servants, privies or howsoever from further trespassing into, erecting any structure or structure thereon or alienating in any form the piece of land subject mater(sic) of (sic) suit.</p><p>d. The cost of the suit.</p><p>According to the Appellant, he bought the land in dispute from the PW1 for N1 million.</p><p>PW1…</p>
