Judgement

EBIOWEI TOBI, J.C.A. (Delivering the Leading Judgment): The Appellant was Claimant at the lower Court while the Respondents were the Defendants. The Claimant sued the 1st and 2nd Defendants claiming title to 25 plots of land he claimed was sold to him by the 2nd Defendant. The 2nd Defendant denied selling the land in dispute to him. The 3rd-13th Defendants were joined in the suit consequent upon their application. There was therefore four sets of parties in the suit in the lower Court with their different claims. The Claimant is the first party with claim of ownership of title over the property lying and situate at Gombole Road, Old GRA, Maiduguri. The second party is the 1st Defendant who defended the suit and went on to file a counterclaim against the Claimant and the 2nd Defendant. In the counterclaim, the 1st Defendant claimed title to land measuring 12383.84 sqm situate off Gombole Road, old GRA covered by Right of Occupancy NO. BO/24234 which was granted to him.
