JIMI OLUKAYODE BADA, J.C.A.(Delivering the Leading Judgment): This appeal emanated from the Judgment of the High Court of Justice, Delta State of Nigeria in Suit No A/240/08 Between: MRS NKIRU STELLA UMEH V. GUARANTY TRUST BANK PLC delivered on 3rd day of November, 2011.
Briefly, the facts of this case are that the Respondent commenced an action at the lower Court against the Appellant (which was Defendant at the lower Court) for a recovery of N1.5 million Naira and interest therein in a contract of fixed deposit she entered with the Appellant.
At the conclusion of hearing, Judgment was entered in favour of the Respondent in the following terms: -
(1) The sum of (N1,560,000.00) One Million, Five Hundred and Sixty Thousand Naira being the Claimants investment with the Defendant and interest accruing thereto as of the maturity date of April 8th 2007.
(2) Interest on the said sum at the rate of 20% per annum, from this date until the Judgment debt is liquidated.
