DANLAMI ZAMA SENCHI, JCA (Delivering the Leading Judgment): This appeal is against the judgment of the High Court of the Federal Capital Territory, Abuja in Suit No: FCT/M/3321/2011, delivered on 15th October, 2012 coram: M. A NASIR J.

The Appellant (Applicant at the Trial Court) instituted this action on the 17th November, 2011 to enforce his Fundamental Rights as guaranteed under Sections 34, 35, 36 of the 1999 Constitution as amended and Article 3, 4, 5, 6 and 18 of the African charter on Human and Peoples' Rights. The Appellant therefore claims against the Respondents as follows:-

1. AN ORDER restraining the Respondents, their agents/privies or otherwise, from further arresting, harassing, assaulting, detaining or in any other manner disturbing the liberty, freedom and normal life of the Applicant.
