DANLAMI ZAMA SENCHI, JCA (Delivering the Leading Judgement): This is an appeal against the judgment of the High Court of Justice sitting at Ankpa in its appellate jurisdiction in appeal No. OHC/lA/2014 delivered on the 29th day of June, 2016 Coram; J.J ME-JABI, J (presided), F. AJAYI, J (delivered the lead judgment) and M.M Gwatanwa, J.

The Appellant (as Plaintiff at the Upper Area Court Okpo hereinafter referred to as the trial Court) filed Suit No. CV/56/2011 for a claim for trespass, injunction and damages against the Respondents (Defendants Counter Claimants at the trial Court). In order to prove his case against the Respondents at the trial Court, the Appellant testified as PW1 and three (3) documents were received in evidence as exhibits P1, P2 and P3 respectively. The 2nd Respondent testified before the trial Court and called one other witness Zekeri Adejoh who testified as DW1.
