MARY U. P. ODILI, JCA (DELIVERING THE LEADING JUDGMENT): The appellant applied to be admitted to bail before the High Court of Justice, Kogi State, holden at Lokoja Coram, Justice A.A.O. Ajileye who refused the bail application. Aggrieved for the decision of the lower court the Appellant has appealed to this court.

FACTS BRIEFLY STATED

The appellant was arraigned before the Court Magistrate Court I Lokoja for the offences of Criminal Conspiracy and Armed Robbery 398 Laws of the Federation 1990 as contained in the first information Report. The Appellant applied for bail at the Chief magistrate Court 1 and the court refused the application and ordered that he should be remanded in prison custody at Federal Prisons, Kotonkarfe.

Sometime in September 2005, he applied for bail to the High Court and the court refused the application. Sometime in October 2005 after the ruling of the court, the Chief Judge of Kogi State during his prison visit to the Federal Prisons Kotonkarfe, reviewed the …
