SANUSI JCA (Delivering the Lead Judgment): This is an appeal against the judgment of the Federal High Court, Kaduna division, (hereinafter referred to as the lower court) dated 26th March 2004 in suits Nos. FHC/ KD/CP/24/2001 and FHC/KD/CP/26/2002 which were consolidated by the said lower court. The facts of the case which gave rise to this appeal are summarized as below. On 30th of June, 1982 the appellant herein was employed by the 1st respondents. His appointment was confirmed on the 25th of September 1984. On 24/6/1992, his service was transferred to the Institute of Health of the University (i.e. 1st respondent), where he continued working and rose to the rank of a senior lecturer and later a consultant in the Department of Obstetrics and Gynecology. On 26th September, 2001, one Mrs. Salamatu Usman, a 600 level medical student wrote a petition to the University’s vice-chancellor against the appellant herein, alleging sexual harassment to her person and victimization.
