Judgement

MASSOUD ABDULRAHMAN OREDOLA, J.C.A. (Delivering the Leading Judgment): The respondent herein was employed as a security guard level 2-2 in the services of the 1st and 2nd appellants on 1st October, 1998. Confirmation of his employment took effect from 1st April, 1999. The said employment was withdrawn with effect from 18th March, 2005. The respondent was paid the sum of N240, 531.37 as his full entitlement upon his discharge from the said employment. The respondent maintained that the sum of N641, 583.68 was his due entitlement and he approached the appellants through his solicitors in respect thereof. Upon being rebuffed by the appellants, the respondent instituted an action against the appellants by way of undefended list procedure, at the High Court of Justice, Cross River State, holden at Calabar, in his bid to recover the outstanding balance of his asserted due entitlement.
