MOJEED ADEKUNLE OWOADE, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of M. A. Adeigbe J. delivered at the Ile - Ife Judicial Division of the High Court of Osun State on 12th day of October, 2009.

By a motion on notice No. HIF/M29/2008 dated 29th day of October, 2009, the appellants as applicants in the court below applied under Order 44, Rule 4. Order 40 Rules 1 and 3 of Osun State High Court (Amended Civil Procedure) Rules 2008 and sought.
