Judgement

EKPE, JCA (Delivering the Lead Judgment): This is an interlocutory appeal by the plaintiff/appellant against the ruling of Okoro, J. sitting at High Court, Uyo in Akwa Ibom State in suit No. HU/262/99 on the admissibility of a document tendered in evidence at the trial. In the ruling, the learned trial Judge rejected as inadmissible in evidence, the duplicate copy of the document tendered in evidence by the appellant’s counsel. The ruling appealed against was delivered on 18th April, 2000.

In the court below, the plaintiff, now appellant, by a writ of summons sued the defendant, now respondent, claiming from the respondent the following relief:

“The plaintiff claims from the defendant the sum of ₦777,110.59 (Seven hundred and seventy-seven thousand, one hundred and ten naira, fifty-nine kobo) being amount outstanding and owed to him resulting from the sponsorship by the defendant of Chess Competition which took place at Eket, Akwa Ibom State in October, 1997.
