JUDGMENT

AMALEBOBA, J.

The undisputed facts of this case are that the parties were married under the Marriages Act 1884 – 1985 (CAP 127) at the Everlasting Gospel Ministry in Accra after which they co- habited in Accra and Kumasi. The parties have one  issue of the marriage by name George Owusu Asiedu, aged three, and no  proceedings in respect of this suit have been instituted in any Court. 

The wife - Petitioner filed a Petition against her husband, the Respondent seeking the following reliefs; 

i. That the said marriage be dissolved. 

ii. That the Petitioner be granted custody of the child of the household George Owusu Asiedu. 

iii. That the Respondent be ordered to make to the Petitioner such maintenance pending suit and thereafter such periodical payments  as may be just.

iv. That in the alternative, the Respondent be ordered to pay a lump  sum of money as the Court consider[s] appropriate. 

v. That the uncompleted building located in Obuasi be settled in favour of the Respondent.
