RABI'U JAFARU V. STATE

ABDULLAHI MAHMUD BAYERO, J.C.A. (Delivering the Leading Judgment): This appeal arose from the judgment of the High Court of Justice of Katsina State delivered on 23rd March, 2018 wherein the lower Court convicted and sentenced the Appellant to death by hanging for the offence of Armed Robbery contrary to Section 1 (2) (b) of the Robbery and Firearms (Special Provisions) Act, Cap R11 LFN 2004. The Appellant and one Salisu Abdullahi were arraigned before the lower Court vide a two count charge of Conspiracy and Armed Robbery contrary to Section 6 (b) and 1 (2) (b) of the Robbery and Firearms (Special Provisions) Act Cap R11 LFN 2004 respectively. The lower Court convicted and sentenced the Appellant to death by hanging for the offence of armed Robbery while the co-accused was discharged. The Appellant, alongside the Co-accused one Sanusi Abdullahi were arraigned before the lower Court on a two-count charge of Conspiracy and Armed Robbery contrary to Section 6 (B) and Section 1 (2) (b) o…
