<p><strong> FABIYI JCA (Delivering the Lead Ruling): </strong> This ruling is sequel to A arguments canvassed in respect of the motion on notice dated 13th July, 2006 and filed on 27th July, 2006. Therein, the 4th appellant/applicant prayed for: </p><p>“1. An order allowing the appellant/applicant to withdraw its appellant’s brief dated 9th July, 2003.</p><p>An order extending time within which the appellant/ applicant may file and serve a fresh appellant’s brief dated 1st February, 2006.</p><p>An order deeming the already filed and served appellant’s brief dated 1st February, 2006 as properly filed and served. An order granting leave to the 4th defendant/appellant/ applicant who is also a cross-respondent to the cross-appeal filed by the 10th - 16th plaintiffs/respondents herein, and extension of time within which to file the cross-respondent’s brief.</p><p>An order deeming the already filed and served 4th defendant/cross-respondent’s brief as properly filed and served.</p><p>And for such further or other orders as this honourable court …</p>
