JUDGMENT OF THE COURT

This is an appeal from the judgment of the High Court (Sergon, J.) dated 14^th May 2010 in which the learned judge made the following orders against the appellant as the personal representative of the estate of Moses Kamau O. Mwangi (deceased):

THAT the Land Registrar, Murang’a is directed to cancel the name of Moses Kamau O. Mwangi (deceased) from the register as proprietor of L.R. No. NGINDA/SAMAR/BLOCK 2/315 and in its place the name of Humphrey Mbaka Nandi be inserted.

THAT cost of this suit to be met by the estate of Moses Kamau O. Mwangi (deceased).

The respondent filed a suit in the High Court seeking inter alia the cancellation of Moses Kamau O. Mwangi (deceased) as the registered proprietor of LR No. NGINDA/SAMAR/BLOCK 2/315 and his reinstatement as the registered proprietor of the suit property.
