HARUNA SIMON TSAMMANI, J.C.A. (Delivering the Leading Judgment): This appeal is against the Judgment of the Oyo State High Court of Justice, Coram. A. A. Gbolagunte, J delivered on the 08/12/2011 in Suit No: HOY/MISC/27/2009.

The Appellant as Applicant in the Court below, had initiated the suit subject of this appeal, by way of an Application for the Enforcement of Fundamental Rights pursuant to Order 1 Rules 2 and 3 of the Fundamental Rights (Enforcement Procedure) Rules, 1980. By paragraph 2 of the Amended Statement made in support of the Application, the Applicant/Appellant sought the following reliefs:

DECLARATION that forceful dissolution of the Applicants Association of Oyo Muslim Community (Youth Wing) and the purported merger of same with another separate association of Muslim Community of Oyo State, Oyo Chapter by the 5th Respondent is improper, illegal and unconstitutional and violate the Applicants Fundamental Right to freedom of peaceful assembly and association as guaran…
