Judgement

A. FATAYI-WILLIAMS, J.S.C. (Delivering the Leading Ruling): This is an application by the defendant/appellant for an order for extension of time within which to appeal, and for leave to appeal, against the order of the High Court of Lagos State dated 19th May, 1975. The applicant, in addition to asking for any further or other orders which we may deem fit to make, is also asking for an order that the notice of appeal already filed with the application should be deemed to have been duly filed.

The order complained of was made on 19th May, 1975 during the hearing of an application for leave to appeal against an earlier order of the same court made in an action which was commenced in the court on 8th July, 1974, whereby the plaintiffs/respondents claimed against the defendant/appellant an order that an account be taken of the money, rents, profits, or compensation received by the defendant/appellant and his agents or representatives in respect of certain properties owned by their grandfa…
