This is a motion on notice to strike out plaintiff’s writ of summons and  accompanying statement of claim for disclosing no reasonable cause of  action against the defendant under order 11 rule 18 of C.I 47, and to  dismiss the suit on grounds that the plaintiff has no capacity to institute  this action. 

The plaintiff instituted this action on 2nd February 2017 with the following  reliefs: 

1. General damages for GHC 500,000 for negligently causing the death  of the late Emmanuel Elikplim Nyatuame.  

The heads of general damages came under:  

a. compensation for the surviving mother 

b. compensation for three surviving children

c. compensation for pain and suffering  

d. loss of expectation of life 

e. loss of prospective dependency 

f. general expenses 

g. medical expenses 

Emmanuel Elikplim Nyatuame met his untimely death on 2nd June 2009 in  a motor traffic accident caused by the negligence of the 1st defendant.  Plaintiff, the younger brother of the deceased Emm…
