RULING

ASUMAN-ADU, J.

Plaintiff commenced the instant action against the Defendants by filing writ of summons together with statement of claim on 18th July 2012 for the following reliefs:

(a) An order that Defendants pay the outstanding severance award of US$36,245.60.

(b) Interest on the total sum till date of final payment.

(c) General damages.

(d) Costs.

(e) Any other orders that the court may deem fit.

Each of the Defendants entered appearance and went on to file statement of defence denying the Plaintiff’s claim. Plaintiff filed a reply to each of the statement of defence filed by the Defendants.

At close of pleadings the court set down the following issues for trial:

a. Whether or not Plaintiff is an unsecured creditor;

b. Whether or not first and second Defendants treated other employees as unsecured creditors;

c. Whether other employees of the defunct Ghana Airways Company Limited have received their severance awards;

d. Whether or not the Plaintiff’s action is maintainable at law.
