BABA ALKALI BA'ABA, JCA (Delivering the Leading Judgment): This is an appeal against the ruling of the Kebbi State High Court of Justice, presided over by Hon. Justice I.B. Mairiga, delivered on the 30th day of March, 2006 and the 4th day of April, 2006 in case No. KB/HC/14/2005 wherein the court declined to entertain the ex-parte application for injunction filed by the appellant and instead ordered that the respondents be put on notice and ruled that the application filed by the respondents challenging the jurisdiction of the court must be heard and determined before the court can entertain any other matter or application.

The appellant was the 19th Emir of Gwandu and was deposed sometimes in the month of June 2005 by the Governor of Kebbi State and the 13th respondent was duly appointed as the new Emir of Gwandu.
