J U D G M E N T 

Introduction 

Madam Christine Akanyife until her death in the year 2001 was the queen mother of  the Volo Traditional Area in the Volta Region. Upon her death, she was survived by  her four children Emmanuel Datsomor, Esi Nyamedzi, Jones Bessa (the plaintiff in  this suit) and Newton Ahanogbe (the defendant in this suit). She also left behind some  properties one of which is the subject matter of this suit. At the time this suit was  instituted, Emmanuel and Esi had also joined their mother into glory. 

Plaintiff’s Case 

It is the plaintiff’s case that in 1982, his mother acquired a parcel of land at Swanlake,  North Kaneshie from the Nikoi Olai Stool of Asere, and at the request of his mother,  he contributed financially towards the construction of two apartments on the land. He also contributed in kind by helping carry blocks during the construction and also  helped his mother to acquire the title documents over the land.
