JUDGMENT

(1) This is an appeal against the decision of the High Court, Cape Coast delivered on 6th August, 1992 in favour of the Plaintiffs/ Respondents against the Defendant/Appellant.
(2) The facts antecedent to the decision of the High Court are as follows:
JACOB WELLINGTON HAIZEL, father of the Plaintiffs and MARY BENSUSON alias MADAM EWURAKUA were married under Custom sometime in 1951. Both of them were resident at Dunkwa-On-Offin. At the time of their marriage Jacob Wellington Haizel was an employee of United Africa Company (U.A.C) whilst Mary Bensuson was a well-established trader holding passbook of the U.A.C, G.B Olivant and S.C.O.A, well-known firms operating within Dunkwa-On-Offin.
(3) The Plaintiffs are children of an earlier marriage by the said Jacob Haizel. They were all infants at the time of their father’s marriage to the Defendant, their mother having died earlier in 1951. The U.A.C. granted a lease of land to the said Jacob Wellington Haizel …
