CHINWE EUGENIA IYIZOBA, J.C.A.(Delivering the Leading Judgment): This is an appeal against the judgment of the High Court of Ogun State Otta judicial Division in Suit No. HCT/124/07 delivered on the 4th day of July, 2013. This suit was initiated by the Respondents and was originally against two Defendants: the Appellant Alhaja Sherifat Kalejaiye as 1st Defendant and Chief Daramola Akinronbi as the 2nd Defendant. The 2nd Defendant died in the course of the proceedings at the lower Court and there was no substitution for him. Thus the contest at the lower Court was between the Claimants/Respondents in this Appeal and the 1st Defendant/Appellant herein.
