BIOBELE ABRAHAM GEORGEWILL, J.C.A. (Delivering the Leading Judgment): This is an appeal against the Judgment of the Federal High Court, Makurdi Division, Coram: J. K. Omotosho J, in Suit No: FHC/MKD/CS/118/2022: Hon Abaaga Ushahemba Simon V. Stephen Adah and Ors, delivered on 1/12/2022, in which the claims of the 1st Respondent as Claimants against the Appellant and the other Respondents as Defendants were granted and the 1st Respondent was declared the candidate of the 2nd Respondent for the Makurdi North State Assembly in the 2023 general elections. 

The Appellant was dissatisfied with the said judgment and had appealed against it vide his notice of appeal filed on 13/12/2022 on three grounds of appeal. See pages 200 - 204 of the record of appeal. The record of appeal was compiled and transmitted to this Court on 21/12/2022.
