<p>AMINA AUDI WAMBAI, J.C.A. (Delivering the leading : ): This appeal is against the decision of the Kano State High Court in Suit No. K/254/2005 delivered on 22nd December, 2005 by Patricia A. Mahmood, J wherein judgment was entered in favour of the respondent.</p><p> The respondent Alh. Muhammadu Falalu who was the plaintiff before the lower court, was elected the Chairman of Ungogo Local Government Council of Kano State on the 27/3/2004. In October, 2009, the 1st appellant, (the Kano State House of Assembly), without any complaint against the respondent, passed a resolution recommending to the Kano State Executive Governor, (the 3rd appellant) to suspend the respondent from office and to set up a Judicial Commission of Inquiry to investigate the tenure of the respondent. The said Resolution of the 1st appellant was neither published in its journal nor gazzetted.</p><p> Acting on that recommendation of the 1st and 2nd appellants, the 3rd appellant suspended the respondent from office and also …</p>
