Judgement

JUMMAI HANNATU SANKEY, J.C.A. (Delivering the Leading Judgment): This Appeal is against the Judgment of the Adamawa State High Court delivered on the 08-11-2012 in respect of Suit No. ADSY/10/2010. The suit was commenced by way of a Writ of Summons dated 22-09-10. In accord with the Rules of the Adamawa State High Court, pleadings were duly filed and exchanged, and the matter proceeded to trial. Both the Plaintiff and Defendants adduced evidence in support of their divergent cases through one witness each, and in addition, the Appellant tendered a copy of the Valuation Report of his property which was compulsorily acquired by the Respondents, and this was admitted in evidence and marked Exhibit 1.

The brief facts of the case before the Lower Court are as follows: the Plaintiff's landed property situate along Yola-Mubi Bye-Pass at Jambutu Ward of Jimeta-Yola, Adamawa State, was acquired by the Defendants for public purposes, i.e. for the purpose of making the place a Green Belt, sometiā€¦
