(Delivering the Leading Judgment): This is an appeal against the judgment of the Federal High Court (Kano Division) (the lower Court) delivered on the 16th day of March, 2016, in suit No. FHC/KN/CS/91/2015, by RIMAN, J. The brief background facts leading to the institution of the suit at the lower Court, leading to the appeal to this Court are that, on the 2nd day of December, 2014, the 1st respondent conducted Primary Election for selection of candidates to represent it in the election held on 11th of April, 2015 General Election for Kano State House of Assembly. The appellant and others, participated in the said primary election to select a candidate to represent Gwale Local Government of Kano State. The appellant claimed or alleged that he scored the highest votes, and was declared the selected candidate to contest the election held on the 11th of April, 2015.
