MONICA B. DONGBAN-MENSEM, JCA (Delivering the Leading Judgment): This is an appeal against the Ruling of his lordship, the Honourable Justice H. T SOBA of the Federal High Court, Ibadan Judicial Division Court 1 holden at Ibadan delivered on the 24th day of February, 2009 declaring the case of the Appellant as Plaintiff as statute barred.

The Ruling is at pages 228-258 of the records for this appeal.

The Appellant was dissatisfied with the said ruling and appealed to this court vide the notice of appeal on three grounds as contained in the records for this appeal (pages 185-188).

The Appellant who was Plaintiff at the trial court shall be referred to simply as the Appellant while the Respondents who were Defendants shall be referred to as Respondents in this Judgment.
