CHINWE EUGENIA IYIZOBA, J.C.A. (Delivering the Leading Judgment): The Appellant and three other accused persons namely Ganiyu Lawal, Lukman Adeyemi and Semiu Ganiyu were on the 13th day of October, 2016 in the High Court of Ogun State, Abeokuta Judicial Division Coram O.O Majekodunmi J. convicted of the offences of Conspiracy to commit Murder and Murder contrary to Sections 324, 316 and punishable under Section 319 of the Criminal Code Law, Laws of Ogun State of Nigeria 2006. The Appellant herein dissatisfied with his conviction filed this appeal.

THE FACTS

The case of the Prosecution is that on the 15th day of July 2000, at about 8 a.m., the Appellant and the three accused persons were at a construction site as casual workers. The 1st accused person (Ganiyu Lawal) engaged the deceased (Maria Adeniji aka Iya Ibeji) to be fetching water in the site. The deceased never returned home after the days job.
