Judgement

TUNDE OYEBANJI AWOTOYE, J.C.A. (Delivering the Leading Judgment): This is the appeal against the judgment of Aikawa J. of Federal High Court Sokoto Judicial Division delivered on 22/5/2015.

The plaintiff at the lower Court (now the appellant) filed an originating summons on 18/2/2015 seeking for the determination of the following question:-

1. Whether or not going by the provisions of Section 65 (1) (b), (2) (a) of the Constitution of the Federal Republic of Nigeria, 1999, as amended, which stipulated the minimum age and educational requirements for a person elected as member of Federal House of Representatives, the 1st defendant is qualified to contest the (sic) election having failed to attach evidence of his age and educational qualifications.

2. Whether going by the provision of Section 31(1) (2) (3) and (5) of the Electoral Act Cap. 15 2010 LFN and INEC form CF 001 which stipulates the conditions to be compiled with the submission of the list of the candidate and their affidavits to…
