(Delivering the Leading Judgment): The substance of this appeal reminds me of the once famous video titled “the rich also cry”, otherwise, how do we describe a once bubbling marriage conducted in the year 1996, to which all the parties had sworn before the Court and before God to stay together till death do them part, land in Court after few years seeking for the dissolution of the marriage.
The record herein shows that Mr. Ovuozourie Samuel Macaulay, of No. 2 Ayo Aduba Street, Core Area, Asaba Delta State and Mrs. Stella Ngozi Macaulay prior to the action that germinated the instant appeal were living as husband and wife, and the marriage blessed with three children aged 12–18 years, all schooling in England, outside the shores of this Country. Evidently too, God had blessed the petitioner having served his State in very eminent positions, as commissioner, and Secretary to the Delta State Government amongst others.
