JUDGMENT

GYAESAYOR, JA

The judgment, the subject of the appeal emanates from the Land Division of the High, Court, Accra and is dated 15^th February, 2012.

The plaintiff/appellant (hereinafter called plaintiff) issued a writ of summons against the two defendants on 13^th August 2002 claiming;-

1. A declaration that plaintiff is a lessee of all that piece or parcel of land forming part of H/No. B420/7 Awudome estates Accra (The out house).

2. An order restraining the 2^nd defendant from erecting a storey building upon plaintiff’s roof of plaintiff single storey building put up in H/No. B420/7, Awudome estates Accra (The out house).

3. Cancellation of any lease agreement purporting to have been made between the 1^st and 2^nd defendant touching upon plaintiff’s leasehold property in the said H/No. B420/7 Awudome estates.

4. General damages against the defendant.

The suit after going through the hands of several judges was finally determined on 15^th February 2012. The judgment so delivered went agains…
