JUDGMENT

 ADJEI, JA

The Plaintiff/Respondent herein instituted an action against the Defendant/Appellant in the High Court, Accra claiming, inter alia, for a declaration of title to a Plot of Land at La measuring 0.098 hectare or 0.243 acre bordered on all sides by Nmati Abonase Quarter lands; recovery of possession, an order to remove any structure or thing put on it by the Defendant, an order for perpetual injunction, and general damages for trespass. For the purposes of this appeal and brevity, the parties shall maintain their respective designations before the trial High Court. The Plaintiff/Respondent shall be referred to as Plaintiff and Defendant/Appellant as Defendant. The Defendant also counterclaim against the Plaintiff for an order of cancellation of the  Land Certificate issued to the Plaintiff by the Lands Commission with respect to the disputed land and a further order compelling the Lands Commission to register Defendant’s title to the said land.
