JUDGEMENT OF THE COURT

Martin Tindi Khaemba, the appellant, an advocate of the High Court of Kenya is aggrieved by the Ruling and Order of the High Court (Ogola, J.) of 31st May 2017 wherein the court determined that his Judicial Review application to prohibit proceedings in Disciplinary Cause No. 155 of 2015 against him scheduled for hearing on Monday 18th April 2016 before the Advocates Disciplinary Tribunal (the Tribunal) was premature.

On 26th April 2016, the appellant filed a Chamber Summons in the High Court. In the application he sought for leave to apply for an order of certiorari to remove into the High Court and quash the proceedings of the respondent in Disciplinary Cause No. 155 of 2015, against the exparte applicant scheduled for hearing on Monday 18th April 2016; leave to apply for orders of Prohibition prohibiting the respondents, interested parties or any person acting in their behalf from continuing with Disciplinary Cause No. 155 of 2015 against him on the hearing dateā€¦
