Judgement

ODUYEMI, JCA (Delivering the Lead Ruling): Following the approval granted to the plaintiffs by the High Court of the Federal Capital Territory Abuja, for leave, inter alia , to sue in a representative capacity i.e. for themselves and as representing members of the various zones of the Executive Council of their various Independent Petroleum Marketers Association of Nigeria, the plaintiffs caused a writ of summons to be issued by the said A court against the defendants therein on 30th June, 2000.

By the said writ of summons, the plaintiffs claimed against the defendants as follows:-

“1. A declaration that the illegal election of the lst, 2nd, 3rd, 4th, 5th, 6th, 7th, 8th and 9th defendants as members of the National Executive Council of the Independent Petroleum Marketers Association of Nigeria (IPMAN) held at Abuja on the 23rd day of June, 2000 was unconstitutional, null and void and of no effect whatsoever.
