Judgement

JUDGMENT 

The plaintiff, Maxwell Agyei Addo, caused a writ of summons to be issued out of the registry of this court for the following reliefs; 

1. Declaration of title to the land in dispute  

2. An order upon the defendant to execute a deed of conveyance in plaintiff’s favour  

3. General damages for trespass 

4. Perpetual injunction to restrain the defendant and its agents and assigns from interfering with the plaintiff’s peaceful possession of the  land 

5. Costs 

The facts of this case as gleaned from the plaintiff’s statement of claim are that the plaintiff, in the year 2002, purchased two plots of  land from the defendant at the cost of fifteen thousand dollars. After  the sale, the defendant failed to execute a deed of transfer on behalf of the plaintiff. However, the plaintiff went into possession of the land  by erecting a wooden structure and putting a caretaker in charge of  his property.
