Judgement

SANUSI JSC (DELIVERING THE LEAD RULING): By a motion on notice filed on 30 October 2017, the applicant herein seeks the indulgence of this court to grant him the following orders:

“(a) An order of this honourable court admitting the appellant to bail unconditionally, or upon such reasonable conditions as this honourable court may deem, pending the hearing and determination of the appellant’s appeal against the judgment of the Court of Appeal, Lagos Judicial Division, delivered on 5 July 2017;

(b) And for such further or other orders as this honourable court may deem fit or expedient to make in the circumstance”.

The application is brought pursuant to section 31(1) of the Supreme Court Act, 2004; Order 9, rule 4(1) of the Supreme Court Rules; and under section 6(6) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended). The motion is supported by a twenty-one (21) paragraphed affidavit. The grounds upon which the application is hinged are set out hereunder:-
