(Delivering the Leading Judgment): This is an appeal against the judgment of the High Court of Lagos State, sitting at Lagos Judicial Division delivered by Honourable Justice W. Animahun on the 24th day of November, 2016 in SUIT NO. RELEVANT FACTS
Erstwhile in April, 2013, the 3rd Respondent (same as 3rd Respondent before the lower Court) granted credit facility to a corporate entity known as Silvermoon Nigeria Limited. The Appellant (as Applicant before the lower Court) represented Silvermoon Nigeria Limited at some points in obtaining the credit facility and negotiations of the amount due and the restructuring of repayment.
