JAMES SHEHU ABIRIYI, J.C.A.(Delivering the Leading Judgment): This is an appeal against the judgment delivered on 18th July, 2017 in the High Court of Adamawa State holden at Yola in Suit No ADSY/2/2013 per Hafsat A. Abdulrahaman J. The Respondent was the plaintiff and the Appellant was defendant/counterclaimant in the High Court (hereinafter referred to as the Court below).

The claim of the Respondent against the Appellant was for the following:

(a) A DECLARATION of title over House No. 8, Mali Crescent, Bekaji Housing Estate, Jimeta-Yola, Adamawa State covered by Statutory Right of Occupancy No. ADS/10196 covering an area of about 869.44 Sqm. Based on Bekaji Housing Estate/Owner Occupier Housing Scheme.

(b) AN ORDER for specific performance directing the Defendant to deliver vacant possession of House No. 8, Mali Crescent, Bekaji Housing Estate, Jimeta-Yola, Adamawa State to the Plaintiff, the Plaintiff having lawfully acquired same from the Defendant.
