1 Background
On 30 October 2018, the plaintiff by a writ of summons commenced this suit against the defendant simply for the following reliefs:
i. An order from the Honourable Court declaring that plaintiff is no longer indebted to the defendant.
ii. General damages for the seizer of plaintiff’s vehicle with registration number GC 993 without a court’s order.
iii. An order for the release of the said vehicle.
iv. An order for the release of all securities for the loan.
v. Cost.
2.0 Parties’ case
2.1 Plaintiff’s case
The plaintiff is a businessman trading under the name and style of Micmor Ventures whilst the defendant is a registered company in the financial services. Plaintiff states that he took a loan facility of GH¢150,000 from the defendant in May 2015 that attracts agreed interest of GH¢60,000 that in effect make the plaintiff’s total indebtedness to the defendant stand at GH¢210,000.
